It has been my understanding that the sheriff is supreme is his county since he is the only law enforcement officer elected by the people. Tis was brought to the fore during the controversy around the sheriff in Arizona some years back.
I agree, but it seems many have relinquished this power.I guess it is easier or possibly profitable to go with the flow. Like asset forfeiture,that law was good till they made it unconstitutional and out right illegal. Now many counties are robbing people of their lawful assets without due process. An informed citizenry is vital for justice. Have you read any of the horror stories about this new asset thievery going on now by our LE? I thank every cop I see as I do troops, but this is wrong. To take assets confiscated in a crime is one thing, but to do so without prejudice or due process is a crime in itself.
Yeah, the New York Supreme Court recently found Red Flag laws to be unconstitutional for the reason you mentioned--no due process.
The Sheriff's primary duty is to operate the Jail, they may patrol unincorporated or other areas by contract, sure. In other words, he has no administrative authority over police agencies.
The Supreme Courts in NY are trial courts, the New York Court of Appeals is their highest court, they term theirs different.
I just read that the Supreme Court made the declaration. Perhaps my info was incorrect. Was this done in the Court of Appeals or not at all? It was stated as Supreme Court Justice Thomas Moran wrote the decision. Where does he sit?

That is simply commentary. A County is a subdivision of the State and they get their authority from state law, they are not above any police agency, like I said, his main function is to operate the County Jail.
It is hard to understand all these laws they have tried to hide from us. At this point and time, I guess it may not matter anymore, because they make their own laws. Richard If you think you may be interested in this subject debate, it will be fun to research it. I gave you a couple starts.
