    If congress so chose, it could propose that the number of justices remain as they are. The constitution only says that the president should do the recommending and then the senate has to go through the seating process of yea or nay.
    The number of justices is by statute and not a constitutional issue. Roosevelt tried to bring on a bill that would add an extra 10 justices but it was denied by congress.

    The Supreme Court convened today and if a tie is reached on either issue on the docket then a lower court has to make the tie breaking decision. Now do note this though. The Supreme Court cannot make law but interpret the constitutionality of a law whether proposed or already enacted so it's not a life nor death situation in "most" cases.

    But, to answer the topic query, even though we have a constitutional president who doesn't like the constitution it is his job to RECOMMEND whom ever he wants. All of the rhetorical garbage that our politicians have been arguing about will have nil affect in the total outcome. They should be offering up their own choices to the president and doing honest reviews of the ones he has already recommended.

    In my humble estimation, our present resident in the White House cannot dial 911 until he dials 411 much less have a good choice but it is still his job and I would rather see him doing something he is getting paid to do rather than spending his day clutching his 7 iron.

    Well, he said that's what he was going to do, and he's done it @Mari North. I was certainly biting my tongue when I posted it ;).

    It's funny to see so many people (on Twitter and elsewhere, not here) getting up in arms about the potential of Congress stalling the process and rejecting someone Obama nominates, but those same people were o.k. with their party doing so in the past, and no doubt would be o.k. with them doing it again in the future. I don't really consider either party 'mine' at this point, it's more a matter of holding my nose while voting, and hoping the person elected actually cares enough about the country, the citizens, and the constitution to turn things around.
