Jose Alba, a convenience store clerk, took a bag of potato chips back from a little girl after her mother's card would not pay for them. The woman stabbed him in the shoulder and then went to get her boyfriend who came in behind the counter and attacked the clerk (who was 61). Falling after being thrown against the wall and being stood up by the thug, the clerk found the store box knife and stabbed the guy who died in the hospital. NY charged the clerk with 2nd degree murder and the DA put a quarter million dollar bail on him, sending him to Rikkers Island. They have the store tape which shows what happened. No charge was made against the mother. GoFundMe took his account down.
Anyone who lives in the funny farm that is New York can expect stuff like this. That is why so many are leaving.
Perhaps his best would have been to let the girl have the chips and pay for them himself. I figure this is what court thinks he should of done. Regardless, the store owner should have never been attacked. Let me guess, was this a racial thing also? Sad days in America.

I think they should let him charge the man and take it to trial. Wasting more taxpayer money on a self-defense case where there are VIDEOS of the crime... what a damn idiot that DA (dumb ass??) is. "DA" Alvin Braggs... what a guy.
I have said it before , and i will here again. There is a number of people amoung us that choose to support the criminal , and chastise the victim or the police . I have no idea what the hell is wrong with them , but IMO their number is growing...and that is not a good thing.
That's not so very new in the wacko states. Many years ago, in California, someone broke into someone's house in the dead of night, tripped over something on the stairs, and successfully sued the homeowner for his injuries.

Suppose you only watch the video, not knowing any background information at all. Then find out he stabbed the guy 5 times. One might easily come to the same conclusion as the DA. Best to see how it plays out.
Update: Last Friday, Alba was working behind the counter at the Blue Moon convenience store in Hamilton Heights when he got into an argument with a woman after she had trouble paying for a bag of chips and asked if she could open a tab. When Alba declined, the woman’s boyfriend, a felon, Austin Simon, 35, came to the store, went behind the counter, and assaulted him, according to video evidence. As the worker, age 61, tried to fight him off, realizing he was being overpowered, grabbed a knife he used as a tool, a box cutter, and stabbed the assailant five times. At some point, Simon’s girlfriend allegedly pulled a knife from her purse and jumped into the fray, stabbing Alba several times (four) in the shoulder and arm. Alba and his relatives have said his actions were in self-defense and have questioned why Simon’s girlfriend hasn’t been arrested in connection with the incident. The clerk's wounds were left untreated while he was in prison and became infected. There are photos online of the clerk's massive wounds on the New York Post site. The girlfriend cannot claim self-defense. Under the law, she assaulted the clerk. The clerk defended himself against an overpowering felon with a knife kept for use as a tool, not a knife kept for defense. The girlfriend, on the other hand, had an assault knife in her purse solely to be used as a weapon. The girlfriend was in no danger and she clearly assaulted the clerk intending to kill him. She should be charged with attempted murder.
I saw the video. The 61-year-old was defending himself from a possible murder. If he is found not guilty in court he will face lawsuits from the family of the punk and probably have to pay them money. America is lost.
